The petitioner is languishing in custody since 1.10.2018 in a case registered for the offence punishable under Sections 414/34 of the I.P.C.

The prosecution case is that from the intercepted pick-up van, section pipe, fan, diesel pump set etc. were recovered which were alleged to be stolen.

It is submitted by learned counsel for the petitioner that the petitioner's name sprang up on confession of co-accused Sonu Kumar and the petitioner is not connected in any manner with the vehicle in question.

Learned APP submits that the petitioner's name sprang up on confession of co-accused.

Considering the fact that investigation has already

No.11042 of 2019(2) dt.25-02-2019 2/2 been concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa, Nalanda in connection with Nagarnausa P.S. Case No.94 of 2018. However, keeping in view the serious criminal antecedent of the petitioner, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on three consecutive occasions or gets involved in similar nature of offence.
