JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 14.07.2016 passed in Cr. Misc. No. 22704 of 2016, on the ground that the petitioner is suffering in custody since 04.03.2016, prosecution story appears not probable and reliable, the informant has been medically examined and she has been found major, only with a view to extract money the informant has lodged this false case, no offence under Section 376 IPC is made out because it was a consented sex. Learned APP opposes the prayer of bail by submitting that at first the petitioner developed physical relationship with the informant when she was admittedly minor after giving false promise to marry with her.

In the facts and circumstances stated above, at present,

Patna High Court Cr.Misc. No.12153 of 2017 (2) dt.12-04-2017 finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, considering the period of detention, let the trial be expedited and concluded as early as possible, preferably within four months from the date of receipt/production of a copy of this order, failing which the petitioner may be at liberty to renew his prayer of bail.
