JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/323/386/504/34 of the Indian Penal Code and Section 37(b) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner and other named accused persons is that after taking wine they were abusing and threatening to kill to the informant. In the meantime, police came and the accused persons including the petitioner were apprehended.

Submission is that petitioner is in custody since 23.12.2016 and has stated on oath that he has got no criminal

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Aurangabad/Successor Court, in connection with Haspura P.S. Case No.233 of 2016.
