Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-03-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chapra Town P.S. Case No. 592 of 2018 for the offence registered under Sections 420, 467, 468, 471, 406 and 120(B) of the Indian Penal Code.

The allegation is regarding the petitioner having taken compensation amount from the government in the execution proceedings on the basis of fake documents and it is alleged that the land in question did not belong to the petitioner. The learned counsel for the petitioner has submitted that the petitioner is innocent, is having a clean antecedent and is having no complicity in the matter. It is further submitted that the petitioner is already facing a certificate proceeding for recovery of the amount in question which is alleged to have

Lastly, it is submitted that the petitioner is having deep roots in the society and undertakes to join the ensuing investigation as also the trial, if any. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 592 of 2018 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
