JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This application, for grant of anticipatory bail, arises out of Nabinagar P.S. Case No. 115 of 2018 disclosing offences under Sections 3147, 148, 341, 323, 324, 307, 448, 504, 506 and 302 of the Indian Penal Code.

Allegation against the petitioners and several others is of assault to informant and his family members causing injuries to them and specific allegation against one co-accused Mithilesh Yadav, who assaulted on the head of father of informant by means of sword and one of the injured succumbed to his injuries.

Submission of learned counsel for the petitioners is that large number of persons have been made accused in this

No.10310 of 2019(2) dt.20-02-2019 2/2 case and no specific allegation has been attributed to the petitioners rather only general and omnibus allegation has been levelled and the specific allegation is against co-accused Mithilesh Yadav, who assaulted the father of informant by means of sword.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Aurangabad, in connection with Nabinagar P.S. Case No. 115 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
