The petitioner seeks bail in Nautan P.S. Case No. 19 of 2017 registered under Sections 457, 376 and 511 of the Indian Penal Code.

The informant alleged that on 18.01.2007 at about 8 P.M. in the night, Basdeo Yadav (the petitioner) entered into her house and made all attempt to commit rape with her, but on alarm many persons came there.

Leanred counsel for the petitioner submits that the alleged occurrence took place on 18.01.2017 but the victim made her fardbeyan on 24.01.2017. The petitioner is the next door neighbour of the victim and the dispute arose due to carrying sugar

Patna High Court Cr.Misc. No.14163 of 2017 (2) dt.13-04-2017 cane on the bullock cart of the petitioner. That is why this false case has been lodged.

Considering the facts aforesaid, nature of allegation made against the petitioner and the fact that the petitioner is in jail since 21⁄2 months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Bettiah, West Champaran in connection with Nautan P.S. Case No. 19 of 2017.
