The petitioner seeks bail in N.D.P.S. Special Case No. 30 of 2018 arising out of N.D.P.S. Case No. 21 of 2018 instituted for the offences under Sections 8, 20 and 29 of the N.D.P.S. Act.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the 520 kg ganja is recovered and the same is above the commercial quantity and the petitioner was not entitled for bail under Section 37 of the N.D.P.S. Act.

A report was called for from the Trial Court. It has been reported that out of five prosecution witnesses, three

Patna High Court CR. MISC. No.11078 of 2022(3) dt.03-08-2022 2/2 prosecution witnesses have already been examined and the trial is likely to be concluded within a period of three months. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial at earliest preferably within a period of three months from the date of receipt/production of a copy of this order.
