JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 18.9.2015 in a case registered for the offences punishable under Sections 20,22 and 27A of NDPS Act.

The police intercepted three persons viz. Pramod Patel, Rambabu Sah and the petitioner travelling on a motorcycle when from the possession of Pramod Patel 3 kilograms of ganja was recovered. From the possession of the petitioner mobile phone was recovered.

It is submitted by the learned counsel for the petitioner that there is no recovery of ganja from the possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, similarly

Patna High Court Cr.Misc. No.340 of 2016 (2) dt.05-01-2016 2/2 situated co accused Ram Babu Sah has been granted bail vide Cr. Misc. No. 57576 of 2015.

Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Sheohar in connection with Piprahi P.S. Case No. 71 of 2015.
