1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Jale P.S. Case No. 191 of 2019 registered under Sections 406 and 420/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to enmity. Further submission is that the specific allegation is against co-accused Abhishek Kumar. Learned counsel further submits that the uncle of the petitioner had already filed a petition against the informant, his father and brother for initiation of proceeding under Section 144 of the Cr.P.C., with regard to a land (Annexure-P/2). It is further submitted that a proceeding under Section 107 of Cr.P.C. was

Patna High Court CR. MISC. No.15489 of 2024(2) dt.21-03-2024 2/2 also initiated against both the parties vide M.R. No. 294 of 2019 (Ramnaresh Thakur v/s Sonu Thakur and Others), as contained in Annexure-P/3 to the bail petition. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Chief Judicial MagistrateI, Darbhanga/Incharge Successor Court in connection with Jale P.S. Case No. 191 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
