JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 04-09-2017 Heard Mr. Rajeev Ranjan Sinha, learned counsel appearing for the petitioner, counsel for the State and Mr. Vivek Aanand Amritesh, learned counsel appearing for the Central Selection Board of Constable (hereinafter referred to as 'the Board'). Mr. Amritesh, learned counsel appearing for 'the Board' invites the attention of this Court to paragraph 15 of the counter affidavit of 'the Board' in which it is stated that the petitioner belongs to Backward Class Female Non-Home Guard category and secured 102 marks as against the cut off marks of 105. According to the learned counsel for 'the Board', the last of the selected candidate in this category has secured 105 marks and since the
Patna High Court CWJC No.1839 of 2016 dt.04-09-2017 marks secured by the petitioner is below the cut off marks that is the reason for her non-selection.
The counter affidavit was served on learned counsel for the petitioner on 29.8.2017 and there is no rejoinder to the same. Meaning thereby the statement made in paragraph 15 of the counter affidavit goes uncontested.
The writ petition is disposed of.
