JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Special Case (POCSO) No. 86 of 2018, arising out of Bakhtiyarpur P.S. Case No. 199 of 2018, registered for the offences punishable under Section 376 of the Indian Penal Code, Section 6 of POCSO Act and Section 37(c) of Bihar Prohibition and Excise Act. Allegation against the petitioner is of committing rape upon six years old daughter of the informant. Submission of learned counsel for the petitioner is that mother and father of the victim were examined during trial and they have not supported the prosecution case and petitioner is in custody since 15.4.2018.

Heard learned APP also.

In view of allegation and since other witnesses are

Patna High Court CR. MISC. No.8753 of 2020(2) dt.28-02-2020 2/2 remained to b examined, I am not inclined to grant bail to the petitioner. However, since the petitioner is in custody for almost 23 months, learned Special Judge is directed to expedite the trial.

With the above observation, this application is dismissed.
