JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 By way of the present restoration application, petitioner seeks to restore the Criminal Miscellaneous No.69618 of 2018, which stood dismissed for non compliance of order dated 04.12.2018.

Submission of learned counsel for the petitioner is that some defects have already been removed but some defects could not be removed on time due to certain difficulty. There is no willful or deliberate laches on the part of the petitioner. Having considered the averments made in restoration application as well as the submission of learned counsel for the petitioner, Criminal Miscellaneous No.69618 of 2018 is restored to its original file and further two weeks' time is allowed to the petitioner to remove the defects of Criminal Miscellaneous
