JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 This is an application for grant of anticipatory bail in connection with Gopalganj Town P.S. Case No257 of 2018, disclosing offences under Sections 406, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

The instant F.I.R. filed by the Chief Manager of SBI (Agriculture Development Branch), Gopalganj that the petitioner along with several other persons have been sanctioned gold loan on pledge after valuation of the gold and the same was examined on behalf of the bank, the same was found to be in pure.

Submission of the learned counsel for the petitioner is that at the time of sanction of loan, the same was found to be pure and later on it appears that same has been checked by the bank authority and after testing the purity of gold he has issued a certificate the gold is pure and valuation of the pure gold was

However, after some arguments learned counsel for the petitioner submits that he is ready to pay the amount in some installments if some time is given to the petitioner. Heard learned A.P.P. also.

Having heard both sides, in view of the fact and circumstances, let the petitioner is directed to surrender before the learned court below within a period of 08 weeks from the receipt of the order with bank draft of Rs.60,000/- payable to the SBI (Agriculture Development Branch), Gopalganj and that he will be released on provisional bail for six months to the satisfaction of the court below on the condition the petitioner will deposit the rest amount in six equal installments of Rs.40,000/- each, payable in first week of each months, once total Rs.3,00,000/- is deposited by the petitioner, the bail bonds of the petitioner shall be confirmed. However, it is made clear that if the petitioner fail to deposit any installment, his bail bond shall be cancelled.
