The petitioner seeks bail in a case instituted under Sections 394, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with other unknown miscreants looted away the motorcycle of the informant after causing injury upon him.

Earlier the bail application of the petitioner was rejected vide Aannexure-1 to the present application. A report was called for from the trial court regarding the stage of the case. It has been reported that the charge has already been framed and the trial is expected to be

Patna High Court Cr.Misc. No.15515 of 2017 (3) dt.26-04-2017 2/2 concluded within a period of one year.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.01.2016. Charge sheet has been submitted. The petitioner is not named in the F.I.R. His name has come in course of investigation. There is no substantive evidence to suggest his implication in the present case. On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R. His name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Sessions Judge, Muzaffarpur, in connection with S. Tr. No. 464 of 2016, arising out of Kurhani (Turki) P.S. Case No.335 of 2015. (Sudhir Singh, J) Amit/- U T
