JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
Petitioners are languishing in custody for the offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Section 37(A)(B)(C)(D) of the Bihar Excise (Amendment) Act, 2016.
80 liters of toddy was recovered from a hut which was said to be of the petitioners and others. The petitioners are in custody since 21.11.2016 and have stated on oath that they have got no criminal antecedent.
Considering the aforesaid facts, let petitioners, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.12425 of 2017 (4) dt.19-04-2017 Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East Champaran, Motihari/Successor Court, in connection with Kesariya P.S. Case No.317 of 2016, with condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
