====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 15-11-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 297 of 2018 for the offence under Sections 341, 323, 307, 504, 506, 34 and 302 of the Indian Penal Code. According to the prosecution, the petitioner along with others assaulted the informant and his family members by lathi and stick as a result of which they sustained injuries and one Pawan Kumar has succumbed before the injuries. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is land dispute between the parties for their respective shares and on account of the same scuffle took place between them. It is further submitted

No.21815 of 2021(3) dt.15-11-2021 2/2 that co-accused, namely, Siliya Devi, Rekha Devi and Sanjay Mandal have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 19.11.2018 passed in Cr. Misc. No. 61448 of 2018. Moreover, co-accused, namely, Bulaki Mandal has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 20.09.2018 passed in Cr. Misc. No. 58676 of 2018. The petitioner is rotting in judicial custody since 05.06.2020.
Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 297 of 2018.
