Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is in custody since 30.05.2018. The petitioner is the main assailant.
In the past, prayer for bail of the petitioner was refused on 26.09.2020 in Cr. Misc. No. 39602 of 2019 with direction to the learned Trial Judge to expedite the trial. Learned counsel for the petitioner informs that not a single prosecution witness has been examined up-till-now. Petitioner has got no criminal antecedent.
Considering the period already undergone by the
Patna High Court CR. MISC. No.19907 of 2021(2) dt.04-08-2021 2/2 petitioner and the undertaking of the petitioner to cooperate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 344 of 2019 arising out of Khusrupur Police Station Case No. 115 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
