JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 273 of the Indian Penal Code and Section 47(A) (E) of Bihar Excise Act.
Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 20.08.2016 passed in Cr. Misc. No. 33979 of 2016 giving liberty to petitioner to renew his prayer for bail, if his trial is not concluded within three months and admittedly, the trial of the petitioner is still pending before the trial court.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.3086 of 2017 (2) dt.01-03-2017 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Kaimur at Bhabua in connection with Sessions Trial No. 508 of 2016 arising out of Bhagwanpur P.S. Case No. 105 of 2016.
