JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner seeks bail in connection with Saheb Kamal P.S. Case No. 108 of 2007 instituted for the offences under Sections 147, 148, 149, 323, 324, 325, 307, 379 of the Indian Penal Code.

The petitioner has misused the privilege of bail granted to him on 14.09.2010 for about ten years. Presently, the petitioner is in custody since 28.11.2019.

Regard being had to the period of custody of the petitioner, this Court directs for his release subject to his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount

Patna High Court CR. MISC. No.11178 of 2020(2) dt.28-02-2020 2/2 each to the satisfaction of learned District & Sessions Judge, Begusarai.

However, the Trial Court would be at liberty to cancel the bail of the petitioner if he absents himself from the trial proceedings for two consecutive occasions without permission from the Trial Court and without any reasonable cause.

While granting bail to the petitioner, an undertaking shall be insisted upon from the petitioner for participating in the trial and not absconding from the proceedings.

An affidavit shall also be required to be furnished by a close relative of the petitioner before grant of bail, who would either be the parents of the petitioner or anyone of his siblings.
