2. The petitioners are apprehending their arrest in Bagusarai Nagar P.S. Case No. 661 of 2024 registered under Section 140(3) of B.N.S.

3. Allegedly, the informant's daughter went out from the house to school but she did not return. Later on, it came to light that the petitioners and one Alok Kumar enticed away the daughter of the informant with ill intention.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and he has falsely been implicated in this case. By drawing my attention towards paragraph-48 of the case diary in which, the statement of the victim recorded under Section164 Cr.P.C. it has been submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.10245 of 2025(4) dt.17-09-2025 2/2 victim stated that she had love and affection with Alok Kumar. She has stated that she went out with Alok Kumar with her own sweet will.

5. On the otherhand, learned counsel for the informant has submitted that the victim is a minor girl and the petitioners are named in the FIR with allegation that they along with their son, Alok Kumar had kidnapped the minor daughter of the informant.

6. The petitioners are parents of the main accused Alok Kumar to whom, the victim had love and affection.

7. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bagusarai Nagar P.S. Case No. 661 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
