JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-03-2021 The present petition has been filed for modifying the order dated 02.02.2021 passed in Criminal Miscellaneous No. 33225 of 2020 to the extent that it be clarified that the amount of loss has been deposited by the petitioner with the Sasaram-Bhabua Co-operative Bank Ltd. Branch, Bhagwanpur, Kaimur and not with the Bihar State Food and Civil Supply Corporation Ltd., Kaimur. It

No.13632 of 2021(2) dt.03-03-2021 2/3 is submitted that on account of inadvertence and on account of typographical error in the main petition, it has been wrongly mentioned that the amount of loss has already stood deposited with the Bihar State Food and Civil Supply Corporation Ltd., Kaimur, however, now, the said mistake has been rectified and it has been categorically stated in paragraph no. 6 of the present petition that the loss amount has been deposited in favour of the Sasaram Bhabua Cooperative Bank Ltd., BranchBhagwanpur, Kaimur. The learned counsel appearing for the Respondents, Sri Shailendra Kumar Singh, does not have any objection with regard to the aforesaid modification, as sought for by the petitioner. Accordingly, it is directed that as far as the order dated 02.02.2021 passed in Criminal Miscellaneous No. 33225 of 2020 is concerned, it would be deemed that the amount of loss has been deposited by the petitioner in favour of the Sasaram Bhabua Cooperative Bank Ltd., BranchBhagwanpur, Kaimur.
