2. The petitioners seeks regular bail in connection with Muffasil P.S. Case No. 724 of 2024, registered for the offence punishable under Sections 317(2), 317(4), 317(5), 3(5) of the B.N.S. and u/s 20(B) (II)c, 29 of the N.D.P.S. Act and u/s 25(1B) (a), 26, 35 of the Arms Act.

3. As per prosecution case, the recovery is of 500 grams of ganja from the possession of the petitioners. It is alleged that the petitioners were found sitting in a stolen truck.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He further submits that the truck was not stolen. Petitioners have one

Patna High Court CR. MISC. No.9920 of 2025(2) dt.06-03-2025 2/2 criminal antecedent and in that case they are on bail. Petitioners are in custody since 15.12.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also period of custody, this application is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the court of learned Sessions Judge, Saran at Chapra/concerned court in connection with Muffasil P.S. Case No. 724 of 2024, with condition that:

(I) The petitioner will mark his attendance at Marhowrah Police Station at first and third week of every Sunday of each month. Default in appearance at the local Police Station will result into cancellation of his bail bond.
