Admittedly, parties are spouses. Petitioner is husband who has been directed to pay ad interim maintenance to the tune of Rs.1500/- per month and further, Rs. 5,000/- as lump sum against the cost of litigation.
Learned counsel for the petitioner submits that there happens to be illegality in the order as, without ascertaining the source of income, such condition has been imposed.
