The Petitioner seeks bail in Amarpur P.S. Case No.415 of 2016 instituted for the offence under Section(s) 467, 468, 471, 419, 420 Indian Penal Code.
Case is based on the basis of the report sent to the Officer-in-Charge, Amarpur P.S., by the GR Clerk, CJM Court, Banka, alleging therein that in Amarpur P.S. Case No.337 of 2016, this petitioner had filed School Transfer Certificate of his son, Ajay Kumar, issued by the Middle School, Dumraon, showing his date of birth 18.03.2000 and prayed to transfer the case to Juvenile Court where the Court called the admission register of Class-I of the Primary School, Dumraon, wherein, date of birth was
Patna High Court Cr.Misc. No.2979 of 2017 (2) dt.04-02-2017 2/2 mentioned as 14.11.1997. On the basis of the aforesaid report, instant case has been filed.
It has been submitted on behalf of the petitioner that both the certificates have been issued by the school authorities. There is no forgery committed by this petitioner. If discrepancy has been found then fault lies on the part of the school administration and not on the part of this petitioner. The petitioner is a poor rickshaw puller and illiterate person, who is in custody since 25.10.2016.
In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No.415 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
