This is an application for bail in connection with Habibpur P.S.Case No. 57 of 2016 registered for the offences punishable under Sections 25(1 b)a and 26 of the Arms Act. It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and he has remained in custody for four and a half months and only allegation against him is that one country made pistol has been recovered. Heard learned APP also, who has opposed the prayer for bail.

Heard both sides. Considering the allegation and period of detention, I am not inclined to grant bail to the petitioner at this stage. However, he may renew his prayer for bail after

Patna High Court Cr.Misc. No.7140 of 2017 (2) dt.20-02-2017 2/2 completion of six months in custody before the court below itself, which shall be considered by the court below keeping in view the period of detention, without being prejudiced by this order, preferably on the same day.

With the aforesaid observations, this application is disposed of.
