Petitioner apprehends arrest in connection with Mahnar P.S. Case No. 307 of 2022 registered for the offences under Section 406 and 420 of the Indian Penal Code and Section 7 of the E.C. Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the present FIR has been lodged after a delay of two month of the alleged incident without there being explanation for the delay. There is no complaint the petitioner by anyone. The license of the petitioner has already been cancelled. Petitioner has no criminal antecedent.

No.11317 of 2023(2) dt.12-04-2023 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 307 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
