JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 384, 147, 149, 341, 353, 354, 506, 342, 504 of the Indian Penal Code and Section 3(1)(ii)(x) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that the informant being Headmistress of the school was humiliated and Rs. 25,000/- extortion was demanded by the petitioner being Secretary of the School Committee and her husband Rajiv Ranjan Tiwary. It is specifically alleged that co-accused Munna Pandey and Annant Halwai tried to outrage the modesty of the informant.

It is submitted by learned counsel for the petitioner that petitioner being Secretary of the School of the Committee enquired about the protest being made by the

Patna High Court Cr.Misc. No.4415 of 2016 (2) dt.01-02-2016 2/2 public for the illegality being committed in the mid-day-meal and the scholarship scheme. Hence, the accusation has been levelled. Moreover, for the occurrence of 26.09.2015 the First Information Report was registered on 27.09.2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation and the fact that there is complaint of irregularity being committed by the informant herself, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi, Patna in connection with Pipra P.S. Case No. 32 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Dinesh Kumar Singh, J) Shageer/- U T
