01-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Laheri P.S. Case No. 479 of 2019 registered for the offence under Sections 420, 406, 379 of the Indian Penal Code.
As per F.I.R., the allegation against the petitioner is that he received a parcel containing mobile phone etc. in the name of other person namely Ravi Shankar and thereafter, he returned the parcel to the Delivery boy, who is informant, by saying that it be delivered to Ravi Shankar. Later on, it revealed that petitioner has changed the mobile phone of the parcel. It is submitted on behalf of petitioner that petitioner is
Patna High Court CR. MISC. No.11660 of 2020(2) dt.01-07-2020 2/2 innocent and has committed no offence. The allegation, levelled against him in the FIR, is out-and-out false and concocted. It is further submitted that petitioner was not present on the date of occurrence, rather he was in Patna and under-going treatment, as per medical prescription annexed as Annexure - 2. In fact, the informant, who is delivery boy, has cooked up a false story. The petitioner has clean antecedent.
Considering the aforesaid facts and circumstances, the bail application is allowed.
In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Laheri P.S. Case No. 479 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
