BAJANTHRI) 12-02-2025 The present MJC is filed for recalling the order dated 28.06.2018 passed in LPA No. 1576 of 2017 arising out of CWJC No. 7737 of 2011. For the reasons stated in application read with the affidavit and in the interest of litigant order dated 28.06.2018 passed in LPA No. 1576 of 2017 stands recalled. Hence, LPA No. 1576 of 2017 restored on the file.

2. Registry is hereby requested to list this matter before the concerned Roster Bench at the earliest.

3. In the present case, cost is warranted, for the reasons that MJC to recall the order dated 28.06.2018 was filed in the year 2018 itself. However, there are serious lapses on the part of counsel for the petitioners in not getting listed the matter

Patna High Court MJC No.3095 of 2018(3) dt.12-02-2025 2/2 for about eight long years. That apart, today he was asking for adjournment and it was refused. Therefore, petitioners are liable to pay cost of Rs. 5000/- (Rupees Five Thousand Only). Cost shall be remitted in the Lawyers' Association Welfare Benevolent Fund, Patna bearing Account No. 7801893276, IFSC Code- IDIB000l501 within a period of four weeks from today.
