====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-05-2019 Heard learned counsel for the petitioner, informant and the learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code. The victim-girl has supported the allegation, in her statement, under Section 164 Cr.P.C., that the petitioner and others forcefully took her to Sikkim and the petitioner ravished her.
Considering the statement of the victim-girl, who is a minor girl, I am not inclined to enlarge the petitioner on bail in connection with Abadpur Police Station Case No. 108 of 2017 pending in the court of learned Chief Judicial Magistrate, Katihar.
Hence, prayer for bail is refused.
Learned trial court is directed to expedite the trial. (Birendra Kumar, J) Kundan/- U T
