JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been caught by the informant while petitioner had entered into the house of the informant for committing theft of Mobile. Petitioner does not have any criminal antecedent and is languishing in jail custody since 22.9.2015.

The impugned order of court below shows that Nathnagar P.S. Case No.15 of 2014 as well as Nathnagar P.S. Case No.210 of 2015 had been registered against the petitioner but para-10 of the petition reveals that the aforesaid finding is an error of record as the aforesaid cases had been lodged against Sanideo Kumar son of Om Prakash whereas name of the petitioner's father

Patna High Court Cr.Misc. No.58023 of 2015 (2) dt.04-01-2016 2/2 is late Dinesh Das.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely, Sanideo Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Nathnagar (Maksudanpur) P.S.
