ANJANA MISHRA ORAL ORDER 23-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Complainant Case No. 940 (c) of 2015 for the offences registered under Sections 406 and 376 of the Indian Penal Code. Earlier the matter was referred to the Mediation Centre but the effort of reconciliation of dispute has failed. As per the allegations made in the first information report and also the fact that the victim girl was over 18 years of age and had been consistently co-habiting the petitioner, it appears that the consent was voluntary.

No.4122 of 2016 (5) dt.23-06-2016 Considering the facts and circumstances of the case and also the fact that petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., IIIrd, Munger in connection with Complaint Case No. 940 (c) of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
