The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
Prosecution case is that on protest being made for cutting the edge of the land of the informant co-accused Gullu assaulted on the hand of the informant with sword when son of the informant came to rescue then co-accused Santosh assaulted with 'farsa' on his head. It is further alleged that when elder brother of the informant came to rescue then he was also assaulted by the accused persons.
It is submitted by learned counsel for the petitioner that accusation of assault is not against the petitioner.
Patna High Court Cr.Misc. No.3277 of 2016 (2) dt.21-01-2016 2/2 It is submitted by learned counsel for the informant that the informant has been convicted in one case by the learned Magistrate but has been released under the Probation of Offenders Act.
Considering the fact that the accusation of assault is not against the petitioner, it is a case for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kachhwa P.S. Case No.54/2015, pending before the learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas.
With the above observation, this application is, accordingly, disposed off.
