IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.7198 of 2017 Arising Out of PS.Case No. -396 Year- 2015 Thana -DUMRAUN District- BUXAR ====================================================== Arjun Kumar @ Prince Kumar, son of Ram Prakash Sah, resident of Village Simri Dev, P.S. Kargahar, District Rohtas .... .... Petitioner/s

Versus

The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Ashok Kumar Pandey For the State : Mr. Sri Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with POCSO Case No.6 of 2016, arising out of Dumraon P.S. Case No.396 of 2015 instituted for the offences under Sections 363, 366A of the Indian Penal Code and Section 4 of the Prevention of Child From Sexual Offences Act.

Admittedly the girl is minor. Allegation has been made that petitioner has taken her to Patna but she was recovered later on.

Learned counsel for the petitioner has very fairly submitted that one witness has already been examined. This case relates to POCSO Act.

Looking to the nature of allegation, this Court is not

Patna High Court Cr.Misc. No.7198 of 2017 (2) dt.15-02-2017 inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to conclude the trial within a period of six months from the date of receipt/production of a copy of this order on the day to day basis. If the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail.
