The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 304(A), 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the petitioner submits that the allegations as made out are not tenable and the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 cannot be attracted in the present case as offence is of petty insult.
Considering the fact that the death was an accident and has attracted merely the provisions of Section 304(A) of the Indian Penal Code and not under various sections of the Scheduled
Patna High Court Cr.Misc. No.3831 of 2016 (3) dt.12-04-2016 P2/2 Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua in connection with Chand P.S. Case No. 115/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
