The petitioner has preferred this application for grant of regular bail in a case registered under sections 304(B) / 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of committing torture and assault and thereafter caused death of the victim due to non-fulfillment of demand of dowry. Learned counsel for the petitioner has submitted that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The

One of the co-accused Manoj Kumar who is brother-in-law of the deceased was granted anticipatory bail by the Coordinate Bench of this Court vide Order dated 26.11.2021 passed in Cr. Misc. No. 55026 of 2021. The petitioner is in custody since since 24.06.2021. The petitioner has clean antecedent as stated in para 3 of the bail petition. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Goraul, P.S. Case No. 528 of 2020, with condition:-
1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled. The application stands allowed.
