The petitioner is accused in connection with POCSO 21/2015 arising out of Thakaraha (Bhitaha) P.S. Case No.173/2014 registered under Sections 376/511 of the Indian Penal Code, under Sections 4 & 18 of POCSO Act and under Sections 3(i)(xi) of SC & S.T. Act.

The accusation against the petitioner is of attempt to commit rape.

Learned counsel for the petitioner submits that the petitioner is next door neighbour of the informant and has been falsely implicated in this case merely on suspicion. It is further submitted that the petitioner has no criminal antecedent and is in

Patna High Court Cr.Misc. No.57590 of 2015 (3) dt.18-02-2016 custody since 04.11.2014.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO, Bagaha, West Champaran, in connection with POCSO 21/2015 arising out of Thakaraha (Bhitaha) P.S. Case No. 173/2014.
