JUSTICE JYOTI SARAN ORAL ORDER 29-01-2016 Heard Mr. Sanjeev Kumar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Ravish Chandra, A.C. to S.C.-16 for the State.

The petitioner happens to be a member of the Primary Agriculture Credit Cooperative Society, Chain Singh Patti in the district of Supaul and has filed this writ petition for a limited relief of disposal of Miscellaneous Case No. 288 of 2015 filed by this petitioner under Section 41(5) of the Bihar Cooperative Societies Act, 1935 for dissolution of the Managing Committee of the society inter alia on grounds that more than 50 per cent of the members have since resigned.

Patna High Court CWJC No.1843 of 2016 (2) dt.29-01-2016 It is submitted by Mr. Mishra that the miscellaneous case having been filed in September 2015, is yet pending even when the affidavits of resignation are a part of record. Having heard learned counsel for the parties and considering the limited relief prayed by the petitioner and the grievance raised herein, I deem it fit and proper to dispose of this writ petition with a direction to the Registrar, Cooperative Societies, Bihar, Patna to consider and dispose of the Miscellaneous Case No. 288 of 2015 in accordance with law and after giving an opportunity of hearing to the petitioner as well as the members of the Managing Committee of the Chain Singh Patti Primary Agriculture Credit Cooperative Society and considering the matter in issue, an expeditious disposal preferably within three months from the date of the receipt/production of a copy of this order would be expected.
