The present writ petition has been filed for directing the respondent authority to enhance the compensation/award to the petitioner for acquisition of land of the petitioner situated at Village- Dubhal, Thana no.328, Plot No.273, Khata No.55 measuring area 0.985 acres along with pumping set, boaring kebin, well (kuan) vide award no.14 and 45.

3. Learned counsel for the petitioner submits that the Land Acquisition Officer, Gaya acquired the land of the petitioner and assess the value of the land in question at

Patna High Court CWJC No.16063 of 2018(3) dt.28-07-2025 2/3 Rs.39,59,636/- (Rupees Thirty Nine Lacs Fifty Nine Thousand Six Hundred Thirty Six), which was received by the petitioner with protest. Counsel submits that the rate of land is very high and less amount has been given to him. Counsel submits that the land in question is situated adjacent to Gaya Town to international place Bodh Gaya. Therefore, petitioner has filed a petition on 01.08.2017 in the court of learned Collector, for determination of fair compensation as per the nature of land in question.

Learned counsel for the State submits that the counter affidavit has been filed in this case and from the said counter affidavit, it become crystal clear that the petitioner has duly received the compensation amount of Rs.39,59,636/- (Rupees Thirty Nine Lacs Fifty Nine Thousand Six Hundred Thirty Six) through Bank Cheque No.0002711 dated 27.04.2011. Counsel submits that the present writ petition has been filed after lapse of about seven years from the date of receiving the full and final payment of the land acquired. Counsel submits that the petitioner has already received the compensation amount just after acquisition and after lapse of about seven years has filed application under Section 18 of the Land Acquisition Act, 1894 (Act no.1 of 1894). From the

Patna High Court CWJC No.16063 of 2018(3) dt.28-07-2025 3/3 documents by which it has been received, it is nowhere mentioned that the said amount has been received in protest.

5. From the pleadings, it transpires that the acquisition amount has already been received by the petitioner. After a lapse of approximately seven years since receiving the said amount, and in the absence of any valid ground, unnecessary litigation has been initiated. Hence, this writ petition stands dismissed. (Dr. Anshuman, J) Divyansh/- U
