This is an application for bail in connection with Kudhani P.S.Case No. 380 of 2016, corresponding to G.R.No. 2719 of 2016, registered for the offences punishable under Sections 414, 464/34 of the Indian Penal Code and Sections 205 and 206 of the M.V. Act.

It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in this case merely on suspicion and he has remained in custody for three months. Heard learned APP also, who has opposed the prayer for bail stating that motorcycle was recovered from the possession of the petitioner and has been made accused in two other similar type of cases.

Patna High Court Cr.Misc. No.6978 of 2017 (2) dt.17-02-2017 2/2 Heard both sides. In view of the fact that petitioner has been arrested with stolen motorcycle and having two more cases against him, I am not inclined to grant bail to the petitioner. However, the court below is directed to expedite the trial and conclude the same within a period of nine months. If the trial is not concluded within the said period, the petitioner will be at liberty to renew his prayer for bail.

With the above observations, this application is dismissed.
