====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 01-03-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending her arrest in a case for the offence registered under Sections 147, 148, 149, 323, 427, 279, 336, 338, 307 of the IPC, 27 of the Arms Act and 3⁄4 of the Explosive Substance Act.
The prosecution story, in brief, is that 36-40 persons having Lathi, Danda, Brick stones and Iron rod started damaging vehicles and shop. Further, they fired and threw Bomb on public causing bullet injury to Santosh Kumar and many persons were injured in the occurrence. The petitioner was identified by the informant while she was involved in the said occurrence.
It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.12789 of 2019(2) dt.01-03-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. The matter has already been compromised between the parties. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VII, Patna, in connection with Kadamkuan P.S. Case No. 656 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
