JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 30 of the Bihar Prohibition and Excise Act, 2016.

Twenty-eight liter of liquor was recovered from the possession of this petitioner.

Submission is that petitioner is in custody since 05.10.2016 and has stated on oath that he has got no criminal antecedent.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.8583 of 2017 (3) dt.10-04-2017 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court, in connection with Bhagwan Bazar P.S. Case No.321 of 2016, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
