The present writ petition has been filed for a direction to the respondent authority to cancel the appointment of Respondent No. 6 on the post of Anganbari Sevika, Gram Panchayt-Tilahara Kalah, Kundwa Chainpur, Block Dhaka, Ward No. 5, District East Champaran, and select the petitioner in place of her.

3. Learned counsel for the petitioner and learned counsel for the State jointly submits that the case filed by the

Patna High Court CWJC No.17150 of 2018(2) dt.03-09-2024 2/2 petitioner before the D.P.O., Dhaka East Champaran i.e. Case No. 52 of 2017 has already been disposed off and if the petitioner is aggrieved by the decision passed by the D.P.O. Dhaka East Champaran then appeal is permissible before the District Magistrate, East Champaran, Motihari as per the relevant Margdarshika for the appointment of Anganwari Sevika and Sahayika.

4. In this view of the matter, the present writ petition is disposed off with liberty that if petitioner is still aggrieved by the order passed by the D.P.O. Dhaka, East Champaran, then she may avail her remedy before the District Magistrate, East Champaran, Motihari.

5. It is directed to the District Magistrate, East Champaran, Motihari that if petitioner files any appeal within 30 days from the date of production/receipt of the order, he shall condone the delay and dispose of the appeal within 90 days from the date of appearance of all the concerned parties.
