JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sadar P.S. Case No. 491 of 2016 instituted for the offence under Section 272 and 273 of the Indian Penal Code and Sections 47, 51, 52, 53, 54 and 57 of Bihar Amendment Excise Act.
It is alleged that huge quantity of foreign liquor as mentioned in the seizure list, totaling about 22.36 liters has been recovered from a truck hidden in the cycle park. The petitioner was driver of the truck who was apprehended on the spot.
Under such circumstances, keeping in view the recovery of huge quantity of liquor, this court is not inclined to
Patna High Court Cr.Misc. No.8997 of 2017 (4) dt.30-03-2017 2/2 grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
The petitioner may renew prayer for bail after six months, if no substantive progress is made in the trial. (Sanjay Priya, J) Ravi/- U T
