The petitioner is accused in connection with Aurangabad (Muffasil) P.S. Case No. 131 of 2016, registered under Sections 399 & 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about making plan to commit dacoity, the Police reached at N.H.31. On seeing the Police personnel, five persons started fleeing, but on chase they were apprehended. On search, one country made loaded pistol was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S. Case No. 131 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
