The petitioner seeks regular bail in connection with Rupaspur PS case no. 399 of 2018 registered for the offence punishable under Section 402, 379 and other sections of Indian Penal Code, 25(1-B)a/26/35 of Arms Act. The allegation is regarding the petitioner having received information that some miscreants had assembled with an intention to commit crime and when the police has reached the said place, the accused persons were apprehended including the petitioner herein. As far as the petitioner is concerned, one countrymade pistol and a live cartridge were recovered.

Patna High Court Cr.Misc. No.10927 of 2019(2) dt.22-02-2019 2/2 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is having clean antecedent and he is languishing in custody since 17.09.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to release the petitioner on regular bail immediately upon completion of six months' of custody i.e. w.e.f. 17.09.2018 subject to such other conditions as may be imposed by the learned court of A.C.J.M.-II, Danapur in connection with Rupaspur PS case no. 399 of 2018. The present petition stands disposed of.
