JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 586 of 2019, registered for offences punishable under Sections 420, 406 and 34 of the Indian Penal Code and Section 30(a), 54 and 57 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of huge quantity of liquor. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered in this case. Further he has no criminal antecedent and has been in judicial custody since 27.12.2019 and chargesheet has been submitted and, therefore, there is no chance of tampering with the evidence.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.8997 of 2020(2) dt.03-03-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya, in connection with Kotwali P.S. Case No. 586 of 2019.
