The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 323, 324, 325, 307, 436, 435, 452 and 380 of the Indian Penal Code.

The allegation is that the accused persons including the petitioner brutally assaulted the informant, her husband and daughters causing grievous injury to them and they also damaged the house hold articles and set the house on fire. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.05.2016. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. No

Patna High Court Cr.Misc. No.8447 of 2017 (2) dt.10-03-2017 2/2 injury is said to have been caused by the petitioner. General and omnibus allegation has been made against the petitioner. The other co-accused have been granted bail vide Cr. Misc. No.39092 of 2016, Cr. Misc. No. 53551 of 2016, Cr. Misc. No. 52597 of 2016 and Cr. Misc. No.52597 of 2016.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 612 of 2015.
