JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that the victim in her 164 Cr.P.C statement got her age recorded as 16 years and the learned Court below also assessed as such, where she stated that she went to the matrimonial house of her sister Renu Devi of her own and stayed for fifteen days and thereafter returned of her own when she came to know that present case has been lodged by her mother. She denied the accusation of being kidnapped and considering the same the family members of the petitioner has been granted anticipatory bail by a coordinate Bench of this

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the 164 Cr.P.C statement of the victim, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Kajraili P.S. Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
