JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
The accusation is of making assault and abusing by calling caste name.
It is submitted by learned counsel for the petitioner that since Neha Kumari, the daughter of one of the accused Prabhu Mehto lodged a case against Umesh Das, the cousin brother of the informant at earlier point of time, hence the informant has been set up to lodge the present case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Patna High Court Cr.Misc. No.4438 of 2016 (2) dt.01-02-2016 2/2 against cousin brother of the informant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Bachhawara P.S. Case No. 201 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
